A MAN was seen driving along a stretch of motorway near Chester totally naked, a court heard.
Neal Marshall, 49, pleaded guilty to an act of outraging public decency after he was seen by a lorry driver on the M56 in the afternoon of August 8 nude and carrying out a sex act in his white van.
West Cheshire Magistrates Court heard the lorry driver saw a white transit van slowly overtake him on the M56.
The lorry driver could see a man by himself in the van with nothing on and as he slowly overtook him, he could see he was performing a sexual act upon himself.
The lorry driver took down the number plate and called the police before Marshall had exitted the M56 at the Chester Services turn-off on Junction 14, near Elton, Chester.
Adrian Evans, defending, said Marshall had completely co-operated with the police after he received a letter asking him who was driving the van at the time and he had admitted the offence at the first opportunity.
Mr Evans also said Marshall, of Strawberry Green, Ellesmere Port, had one previous conviction which was almost identical in 2008 at Stafford Magistrates Court but said his actions were not regular.
He said: “While Mr Marshall does have a relevant conviction, he does not do it month on month let alone every year.”
Mr Evans said the incident took place because Marshall had got “carried away” during a text message conversation with an unknown individual.
Mr Evans handed the court a letter from Marshall apologising to the victim.
In it, he said that he had never intended to be seen by members of the public.
Magistrates sentenced Marshall to a 12-month community order with supervision and a thinking skills course.
They also ordered him to pay £80 court costs and a victim surcharge of £65.
