Man jailed after threatening to 'cut up' takeaway owner

A MAN has been jailed after he threatened a city takeaway owner with a knife and shouted racial abuse at him.

Mathew Winstanley, 21 pulled out the four inch blade and told Yilmaz Huseyin: “I will cut you up” as the Turkish owner shut him out of his Garden Lane fast food shop.

Winstanley, of Park Road South, Birkenhead, had been sheltering from the rain inside Unique Kebab, with his girlfriend when he began shouting racial abuse at Mr Huseyin and his brother after the owners asked the couple to leave if they were not buying food, Chester Crown Court heard.

Jailing Winstanley for 10 months, Judge Nicholas Woodward said: “This was very aggressive behaviour in which you pulled out a knife.

"This must have been very frightening for those involved.

"There was no reason for you to behave in this way when all the Turkish takeaway owner was doing was providing a public service.

"This was a very serious offence committed in a residential area of Chester.”

Winstanley, who pleaded guilty to racially aggregated words and possession of a bladed article, was arrested four weeks after the September 10 incident. He told police he did not remember using racist words because he was intoxicated.

Jo Maxwell, prosecuting, said in interview Winstanly told police he had been carrying the sort of knife that he would use to file nails with – but this was rejected by police.

Adrian Edwards, defending, said Winstanley was remorseful and that he had not set out to threaten Mr Huseyin.

“Winstanley was with his girlfriend, it was raining hard and he went inside the takeaway shop to shelter – it was only as a result of this that the argument had ultimately ensued.

"He (Winstanley) accepts he became embarrassed because the argument was taking place before his girlfriend.

"He lost his temper and he used racist language but never had any intention of injuring anyone.

“He wishes to make it clear that the language he used was said in the heat of the moment. He is not someone who is racist.”
